General

The general terms and conditions of sale described below apply to all products and services sold exclusively through the Special Day Sàrl E-Commerce site. They define the rights and obligations of the parties.
Special Day Sàrl reserves the right to modify the content and form of these terms and conditions at any time.

Personal data

Special Day Sàrl undertakes to respect the confidentiality of personal data communicated by customers on the E-Commerce site and to process them in accordance with legal obligations.

Customer data may be used by Special Day Sàrl's internal departments:

- To process orders, deliveries and invoices
- to inform customers of upcoming sales and events by sending invitation e-mails
- to reinforce and personalize communication with customers, in particular by sending newsletters, special offers and other e-mails.

The customer undertakes to provide the personal information required to manage the order (delivery and invoicing). This information must be correct, valid and up-to-date. Customer identification and password information must be kept secret.

Sales process

Product availability

We buy our products from all over the world. Our suppliers do their utmost to ensure that our entire product range is available to customers in the required quantities and on time. However, it may happen that certain items are temporarily or permanently unavailable due to excessive demand, technical or other reasons.

We will do our utmost to inform you clearly and precisely as soon as possible of any delays in delivery.

The customer is not entitled to claim damages for late deliveries. Special Day sàrl reserves the right to withdraw from the sales contract at any time and without justification.

Product representation and details

Special Day sàrl undertakes to make every effort to ensure that the photographic representation of the products and services offered for sale on the E-Commerce site is as faithful as possible to reality. However, given the way these products are presented on the Internet, it is possible that the customer's perception of the photographic representation of the products may not correspond exactly to the products themselves.

Images are not contractual, and there may be differences between the product on site and the product sold, notably differences in the bathing of fabrics, and slight variations in the color of hand-painted objects, especially wedding figurines.

Items for which several visuals exist or which are available in different colors are delivered according to the models received (model according to arrival). Under no circumstances does the customer reserve the right to choose the visual (except in special cases mentioned on the item sheet).

By default, products are sold without decorations and are to be assembled by the customer. No wedding favors are sold on our site and will not be delivered with the wedding favor boxes. All our balloons are sold uninflated.

For any purchase of sugared almond containers, we advise you to complete the chosen container with food bags for better hygiene.

Orders

Once the desired product has been selected, it is placed in the "shopping basket" by clicking on the "Add to basket" button. The customer may then continue with the selection of items, modify the shopping basket or continue with the order process and pay.
Validation of the order by the customer constitutes acceptance of the general terms and conditions of sale.

Once the order has been validated and paid for, the customer receives an order confirmation by email.

The order validation date corresponds to :

- The date of the order in the case of payment by credit card or
- The date of receipt of payment by bank transfer in advance.

Rental

Special Day Sàrl provides the hirer with decoration or photographic equipment. The equipment is rented for a weekend from Friday to Sunday evening, or any other period agreed between Special Day Sàrl and the customer. For weekday rentals, please contact Special Day Sàrl by email at [email protected] to check availability.

The hirer may return the chair covers before the end of the rental period, but this will not result in any change to the agreed rental price.

1. The rented equipment must be returned in its respective packaging and in its entirety no later than 3 days after the end of the rental contract (as evidenced by the postmark). Shipping costs are at the renter's expense. In the event of late return, the rental price will be increased by 50% per week. Special Day Sàrl is responsible for cleaning the covers, the cost of which is included in the rental charge.
2. At the time of rental, the renter must notify the owner of any damage to the equipment.
3. The hirer is responsible for the equipment from the time it is hired until it is returned. The lessee is obliged to take all the care they require.
4. The hirer may not make any modifications or alterations to the rented equipment. Such work may only be carried out by Special Day Sàrl.
5. Upon return of the equipment, Special Day Sàrl will check the condition of the goods. The hirer is responsible for any damage not reported at the time of rental. The cost of repairs must be paid directly by the hirer. If Special Day Sàrl finds damage to the equipment or irrecoverable stains or tears on the chair covers due to mishandling, each piece will be invoiced to the hirer at the purchase price in force on the last day of rental.
6. Any subletting or lending of chair covers by the hirer is strictly forbidden.

Delivery is free of charge for orders over CHF 99. In all cases, the cost of returns is borne by the hirer. Personal delivery is possible by appointment at our premises in Châbles.

Prices and VAT

The prices quoted for each item on the E-Commerce site are inclusive of all taxes and exclude preparation and logistical costs. Shipping costs will be indicated prior to final validation of the order.
Special Day Sàrl reserves the right to modify the prices and other charges displayed on the E-Commerce site at any time and without prior notice. However, the products will be invoiced to the customer on the basis of the prices in force at the time of validation of the order.
The customer benefits from the prices mentioned by article, valid in the country for which he can indicate a delivery address.

Secure payment

Purchases can be paid for by bank transfer in advance, by credit card or by PayPal. The following credit cards are currently accepted: Visa, MasterCard, Maestro and Discover.
The order will be considered effective after confirmation of the agreement of the bank payment centers.

In accordance with current regulations, and to ensure the security and confidentiality of their information, Special Day Sàrl does not store its customers' bank details. It is therefore the customer's responsibility to save and print the payment confirmation if they wish to retain the payment details relating to their order.
Payments managed by the Special Day Sàrl E-Commerce site are based on the security systems of the payment solution providers PostFinance (www.postfinance.ch) and Paypal (www.paypal.com). You will find all the specific details concerning the security of these platforms on their respective websites.

Payment with Klarna

In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna’s own privacy notice.

Invoice purchase with partial payment option (POWERPAY)

MF Group / POWERPAY offers the "Payment on invoice" payment option as an independent payment service provider. The order invoice simply allows you to pay for your online purchase by invoice. If you decide not to pay on time, you will receive a monthly invoice with an overview of your order the following month. When the purchase contract is concluded, POWERPAY takes over the invoice debt and handles the payment arrangements. In addition to our General Terms and Conditions, you also accept the POWERPAY General Terms and Conditions. (powerpay.ch/en/agb).

Delivery

Shipping costs are calculated at the end of the order process, according to the destination country, weight, volume and the rates of the carrier in charge of delivery. They are clearly indicated during the order process and before final confirmation.

Special Day Sàrl ships goods sold through the E-Commerce site to Switzerland, as well as to other countries if the legislation in force in the countries of shipment (Switzerland) and receipt authorizes the shipment of said product. Products and/or services will be sent to the delivery address indicated by the customer during the order process.

Delivery times depend on each mode of transport, and Special Day Sàrl cannot guarantee delivery of products within a fixed period. It is the purchaser's responsibility to check with the carriers for the usual delivery times from Châbles in Switzerland.

Customs duties

All orders placed on our sites and delivered outside Switzerland may be subject to possible taxes and customs duties which are imposed when the parcel reaches its destination.

These customs duties and taxes are the responsibility of the buyer.

We are not obliged to check and inform you of applicable customs duties and taxes.

To find out, we advise you to contact the relevant authorities in your country.

Responsibilities

Special Day Sàrl may use the customer's e-mail address or telephone number to send information on the status of the order or on return procedures, if applicable.

The customer is responsible for the e-mail address provided. Special Day Sàrl cannot be held responsible for the non-receipt of e-mails.

Special Day Sàrl can not be held responsible for non-performance of the contract, due to the occurrence of an event of force majeure and in particular in case of total or partial strike of postal services, carriers or natural disasters.

With regard to products purchased to satisfy professional needs, Special Day Sàrl shall not be held liable for any indirect damage, operating loss, loss of profit, damage or expenses that may arise.

The choice and purchase of a product or service are the sole responsibility of the customer.

The total or partial impossibility to use the products cannot give place to any compensation, refunding or questioning of the responsibility of Special Day Sàrl, except in the case of a proven hidden defect, of nonconformity, of defect or of exercise of the right of retraction.

Products are delivered to the delivery address indicated by the customer during the order process. If the address is incomplete or erroneous, the customer is responsible for the cost of returning the products.

The customer is responsible for checking the condition of the products at the time of delivery in the presence of the delivery person. If the customer accepts a parcel, it will not be possible to request a report of spoliation from the post office. Once a package has been delivered, Special Day Sàrl is no longer responsible for the merchandise or its condition. No claims will be accepted.

Special Day Sàrl makes every effort to protect items during transport, but is not responsible for breakage during transport.

Returns, retraction and refund

Upon receipt of the product, the customer has a right of withdrawal, i.e. a period of 14 days to return the delivered product, the return costs being at the customer's expense. Only products purchased via the E-Commerce site and returned with their film or individual protective packaging intact (unopened and in their original packaging) will be eligible for a refund. Under no circumstances will shipping costs be refunded.

The product is checked by Special Day Sàrl's internal services, who will validate or not the refund, in particular by checking that the product has been returned complete and in a condition ready for sale, as provided for in the right of withdrawal.

If the goods meet the return requirements, they will be eligible for a refund. If the goods do not meet the return requirements, the customer will have to pay the return costs before the goods can be sent back to him, and he will not be entitled to a refund.

Reference error

In the event of a reference error, you have 72 hours to inform us that the product received is not the product ordered: reference error, problem of size, color, characteristics, completely different product..

The product must be returned in excellent condition. After 72 hours, no request will be accepted.

Processing your return due to an error on our part:

Once your parcel has been received and accepted by our services, depending on the nature of the product, available stocks and your wishes, we will offer to reship the product originally ordered or an exchange product with equivalent characteristics.

Should this not be the case, please provide us with your bank account number so that we can proceed with the refund. The amount will be credited to your account within 15 days of receipt of the item. For accounts not domiciled in Switzerland, international transaction charges may be levied by the customer's banking institution, for which Special Day Sàrl is not responsible.

Once we have received and accepted your parcel, if we are aware of the postage costs incurred by the Post Office, we will refund the amount of these costs. Our customer service department will ask you for an invoice justifying these costs

Please note: The amount of these charges will be based on the current consumer rates communicated by the Post Office. The maximum amount may not exceed CHF 7 for Switzerland.

Applicable law

These general terms and conditions of sale, as well as any sale to which they apply, are subject to Swiss law. Any dispute arising out of, or in connection with, these terms and conditions of sale or any sale to which they apply, shall be governed by Swiss law, whether such dispute is in contract, tort or otherwise. The application of the 1980 United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

Copyright

The production of illustrations and photos for our advertising materials requires considerable investment. All rights of reproduction and distribution are therefore reserved to us and our partner companies. Any misuse may be prosecuted.

Place of performance and place of jurisdiction

The place of performance is the registered office of Special Day Sàrl, Bonnefontaine 4, 1474 Châbles, Switzerland.

In the event of litigation, the place of jurisdiction is expressly Châbles, Switzerland.
